Terms & Conditions

The agreement and acceptance of a formal quote represent the entire understanding of the requirements, schedule, and payment terms for the services listed in your quote and subsequent invoice.

If there are any disputes or actions resulting in legal proceedings related to this contract, such actions shall take place and be subject to the laws of England.

Clients accept sole financial responsibility for any legal fees or related costs incurred by the Photographer in enforcing the terms of this portrait photography contract. Any failure by one or both parties to uphold or enforce a provision of this contract shall not constitute a waiver of any other provision of this contract.

Payment

The Client agrees to retain the Photographer for the services provided by accepting their quote and paying a deposit equal to 35% of the quoted sum for services as a minimum.Payment in full is required on or before the day of the scheduled shoot. The Client acknowledges that no reservation or commitment to the dates requested can be made prior to the acceptance of the quote and subsequent payment of the initial service deposit.

In the event that payment is not made in full by the agreed deadline, the Photographer reserves the right to terminate this job, retain the initial deposit, and no longer be held liable for providing further services to the Client.

Cancellation

The Client may cancel their booking at any time up to 30 days prior to the scheduled date for services. To do so, the Client must send a written cancellation notice via email.

The Client hereby forfeits their initial deposit in case of cancellation and agree to pay the full amount for the services listed above should they cancel any bookings after the date 30 days before the agreed booking.

The client may reschedule the date of the booking no later than 30 days prior to the agreed shoot or service booking with the written approval of the Photographer. Should the Photographer be unable to accommodate the Client’s rescheduled date, the Client will not be held responsible for the remaining balance of this portrait photography contract but will forfeit their initial deposit.

Liability

If the Photographer should be unable to provide the goods and services outlined in this contract for any reason, the Photographer agrees to refund any fees paid by the Client, minus applicable expenses, and shall have no further liability with regards to this contract. This limitation of liability also applies to any loss or damage to footage, photographs, or other materials after the events listed in this contract. The sole remedy for any actions or claims resulting from the Photographer’s inability to deliver the goods and services listed in this contract shall be limited to a refund of monies paid by the Client to the Photographer.

Pricing

Any additional goods or services not included in the accepted quote will be sold at then-current rates. The Photographer makes no pricing guarantees outside of the terms of the agreed quote, and the Client acknowledges that prices for additional goods or services are subject to change suddenly and without notice.

The photographer’s expenses will be covered by the Client. An estimate of expenses will be included in the quote to the Client upon confirmation of location and date/time of the booking for the client to formally accept.

Responsibilities

The Photographer is responsible for bringing any equipment or assistants necessary to conduct the services outlined in the agreed quote and subsequent invoice.

The Client agrees to prevent any other photographers or videographers at the shoot not listed in this contract from interfering with the Photographer’s performance of their duties in this contract. This includes guests and other amateur photographers or videographers.

The Client may bring guests/friends/family but must provide a written email request which is approved by the Photographer prior to the booking date.

The Photographer will not be held liable for compromised event coverage due to interference from other parties not previously outlined or agreed between both parties, including interfering traffic in public spaces. Likewise, the Photographer is not responsible for degraded coverage due to environmental issues, such as poor event lighting, space, weather, or backdrops.

The Photographer will provide the goods and services listed in the accepted quote and subsequent invoice. If additional coverage hours are requested on the day of the events, Clients agree to pay the Photographer in full for those additional hours at the hourly rate listed within the terms, unless otherwise pre-agreed.

The Photographer agrees to make every effort to provide satisfactory coverage, but cannot make any guarantees as to specific photos, poses, etc. during the agreed booking/shoot.

The Client agrees to credit the Photographer on each image that is released to the public on all platforms using the appropriate social handles for MS Photography on Instagram, Twitter, TikTok, Facebook, etc.

Image Processing

Watermarked RAW images will be sent via our dedicated content sharing platform within 72 hours of the completion of the scheduled booking/shoot for the Client to view and choose the images/content that they would like to be edited by the Photographer.

The Photographer will perform skin retouching, color correction, and light adjustments on the chosen images to the Photographers best ability. Any major adjustments to images or composites will result in an extra charge based on the agreed hourly rate listed within the standard terms and conditions.

Final edited images will be sent digitally through our dedicated content sharing platform to the client’s email address for the Client to download. Further images and prints can also be ordered directly from our platform.

Model Release

By accepting the quote for services, you accept the job as a model release. This grants the Photographer the right to use all images and footage without restriction for advertising, portfolios, and other lawful purposes. The Client waives the right to inspect any images produced using the images or footage from the events in this contract, and the right to restrict the use of the images or footage from the listed events by the Photographer.

All photographs and footage are and shall remain the sole intellectual property of the Photographer in accordance with UK Copyright Laws. The Client hereby waives any rights to intellectual property ownership, monetization, or reproduction of the images and footage created by the Photographer, with exception of the terms of any formal written releases provided to the Client by the Photographer.

Unauthorized Reproduction

The Client agrees not to reproduce or modify the images or footage provided by the Photographer or release RAW watermarked images on any platform without first obtaining a formal written release signed by the Photographer. Should the Photographer discover any violations of this agreement, the Client agrees to be held financially responsible at a rate of £250 per violation.
